Welcome to Crevideo! Before you register for your Crevideo account, you must read and agree to these Crevideo Terms of Use and the following terms and conditions and policies.
1. General Conditions, Alterations and Coverage of the Terms and Conditions
1.1 Crevideo/Joachim-M. v.Freyhold (in the following referred to as "Crevideo ") provide use of the website under the following terms of usage.
1.2 Alterations to the terms and conditions are only possible through revisions to this page. Upon receipt of information about the alterations, the user is granted a right of objection of 14 days. The altered conditions are effective and become part of the contract after the objection period has expired or the latest specified date. Upon receipt of an objection, Crevideo reserves the right to withdraw usage privileges within one month of receipt of the objection.
1.3 By registering or using our services, the user accepts the terms and conditions and their coverage. If the user does not agree to these terms, they may not use the services offered.
2. Registration, Preconditions of Participation, Legal Declarations
2.1 To participate, the user must be fully legally competent or act with the agreement of a legally authorized representative. The platform is intended only for fully legally competent users.
2.2 The user is obliged to provide truthful, accurate, up-to-date and complete information on the registration form and always to keep this information up-to-date and correct. After registering, the user receives a confirmation email to be able to activate their user account.
3. Cancellation, Blockage of Member Accounts
3.1 The user can cancel their membership account at any time and without giving any reason.
3.2 Membership fees already paid for the relevant account are non-refundable.
3.3 Upon deleting an account, all information such as photos, videos and contacts are permanently and irreversibly deleted.
3.4 Upon expiry of premium membership, the account is converted to free basic membership. To renew premium membership, the user must renew at least 2 days before it expires.
3.5 A user account is non-transferable. If Crevideo m suspects misuse of an account or access data, we reserve the right to immediately block the user account.
4. General User Duties
4.1 The user is obliged to keep their password secret and protected from third parties, since passing on the password and user name gives that third party access to the account. They can then delete, copy or change the information saved on Crevideo.
4.2 If the user loses their access details, knows or suspects that they are being used by a third party, they are obliged to inform Crevideo immediately and change their password.
4.3 The public profile created by the user displays no personal information and is visible to all Creartivi.com users.
5. Responsibility, User Contents, Forbidden Contents and Practices, Infringements
5.1 Crevideo respects the intellectual property of third parties and requests the same from their users.
5.2 The user is obliged to use Crevideo\'s services legally, and, whilst using them, not to retrieve or spread illegal content or infringe the rights of third parties (particularly commercial protection and competition rights).
5.3 It is particularly forbidden to spread content that endanger child safety or that are of a child-pornographic, extremist or racist nature, as well as viruses and chain letters.
5.4 Using the Crevideo service to carry out malpractices, e.g. intervening in the security measures of a foreign network, host of account (cracking, hacking, denial or service attacks), is likewise forbidden.
5.5 The user is obliged to inform Crevideo of any unlawful usage of the service by third parties immediately. If the user gives a third party access to the service intentionally or unintentionally, knowingly or unknowingly, they accept full responsibility for all online activities of this person, control of access and the use and misuse of all kinds by these persons. The user is personally liable for any misuse that occurs and all incidental costs incurred by the unauthorized use.
5.6 Crevideo is exempted by the user from any claims by third parties due to unauthorized use of the services.
5.7 For all activity, Crevideo is entitled to block membership and all contents of the relevant user immediately without giving reason. The user is permanently barred from membership. Furthermore a complaint is placed.
6. Data Protection
6.1 The user agrees for all their personal data on Crevideo\'s Internet site to be saved and processed according to the German Federal Data Protection Act (BDSG) to the extent necessary to process the contractual relationship.
6.2 Information is treated as confidential and in agreement with the law. Solicitation or processing of the user\'s personal data beyond the extent described here only occurs with the user\'s previous permission.
6.3 Data is only kept as long as it it necessary in the context of this agreement and in compliance with the applicable laws.
6.4 The user has the right to obtain information about their saved personal data at any time.
6.5 The user is fully informed of the type, extent, place and purpose of the solicitation of personal data necessary to conduct services. The user agrees to this data processing explicitly.
6.6 Crevideo does not guarantee the accuracy and completeness of the information provided by Crevideo.
6.7 Crevideo do not completely preclude the possibility of information sent and received by third parties being intercepted and/or appearing on the Crevideo Internet service. Crevideo assumes no liability for damages occurring from such situations. This also applies to the address book managed by Crevideo (which treats data provided by users as confidential). Liability is limited to typical, predictable damages. Transport of the data over the Internet is not influenced by Crevideo. Therefore, no guaranty is given for the forwarding of data (recipient reached, correctness) and thereby Crevideo accepts no liability.
7. Exclusion of Warranty, Links
7.1 Crevideo reserves the right to suspend or discontinue the services in the form which you find good at any time. The user uses the products of Crevideo at their own risk. In particular, this includes the usage and downloading of content from other users from the services of Crevideo. Should the user cause damage to his or her computer system, ancillary technical appliances or loss of data and other damages, they assume sole liability, including for third party damages.
7.2 The contexts of all linked websites are checked by us. Despite careful content control, we accept no liability for the content of external links. The operators are solely responsible for the content of the linked pages.
8. Liability and Limitation of Liability, Exemption of Liability
8.1 Crevideo does not guarantee constant availability of its services and is not liable for damages, which result from services not being available. Crevideo accepts no liability for losses of user registrations and information.
8.2 Crevideo is only liable for gross negligence and intent, which result from its legal representative or vicarious agents. Damages claims are excluded, independent of legal cause.
8.3 The default time zone for the website/database is CET (UTC/GMT +1 hour).
9. Exemption of Liability
9.1 The user hereby declares that they will disclose and/or release demands or claims of any kind, on the basis of, or in connection with content of third parties that the user saves within the Crevideo services to Crevideo, their employees, representatives, shareholders and vicarious agents, and companies connected with Crevideo, upon the first request to indemnify Crevideo.
9.2 On the basis of users using Crevideo products, breaching these terms and conditions or third party rights, this is also applicable and will be enforced.
9.3 The appropriate legal costs are also herein included.
10. Crevideo Brands and Other Protective Rights
10.1 Crevideo is exclusively legally entitled to all rights and markings of Crevideo, including possible patent, copyright, trademark or other rights or comparable legal positions in relation to you.
10.2 Removal of indications of Crevideo\'s legal ownership is liable to prosecution.
10.3 Use of the aforementioned rights are only permitted with explicit prior written agreement from Crevideo.
10.4 Use of the Crevideo brand name is forbidden, as is copying, alteration or dismantling of Crevideo.
10.5 The user is likewise forbidden to produce an adaptation thereof, and also to try to discover the source code.
10.6 The sale, surrender, or allocation of sub-licenses of the software and any commissioning of rights to the software is strongly forbidden, as is maintaining any rights.
10.7 The personal content of the user brought in to the product and the content of other users are exempt from the previous conditions (10.1 to 10.6). In as much as you respect the rights of all other entitled persons to these content.
11. Applicable Law, Place of Fulfillment, Place of Jurisdiction
11.1 German law applies under the exemption of UN Convention on Contracts for the International Sale of Goods.
11.2 Place of fulfillment and place of jurisdiction exclusively is Düsseldorf, Germany, as far as legally permitted.
11.3 Alterations to the contractual conditions must be in writing. Additional verbal agreements are not valid. This also applies to rescission or alteration of these written terms.
